DEFINITIONS: In respect of this agreement the terms: PIXEL - implies Pixel Innovations Limited., authorised licenser of the software. You - implies you, the licensee. LICENSEE: You have the non exclusive right to use the enclosed software on a single microcomputer. If you wish to use the software on more than one microcomputer you must license an additional copy or copies of the software from PIXEL.You have only those rights in respect of the software as are expressly set out in this license. You may not sub-license any other person to use the software. Except as provided in clause 5., below, you may not make, sell, or otherwise distribute any copy of the software or the documentation. TERMINATION: This license is effective until terminated. You have the right to terminate it at any stage, by returning this product to PIXEL. COPYRIGHT: The software and its related documentation are copyrighted to PIXEL, with all rights reserved. By accepting this agreement you do not become The owner of the software but you have the right to use it in accordance with this license. BACKUP: You are entitled to make copies of this software solely for backup purposes. You must ensure that all copyright notices are on all copies of any related components, you must not make copies of this software for any other purpose. You cannot give away free, sell or exchange any copies of this software or documentation. You may not reverse engineer or decompile the software, save strictly as permitted under Section 50B of the Copyright, Designs and Patents Act 1988 (as amended). LIMITED WARRANTY: The software and documentation is provided "as is" without warranty of any kind. The entire risk as to the results and performance of this software is assumed by you. Should the software prove defective, you {not PIXEL or any dealer) assume the entire cost of repair, servicing and correction. PIXEL warrant for a period of 90 days from the effective date of delivery, by evidence of purchase receipt, that under normal use, the magnetic medium will not prove defective. If within this 90 days, the magnetic medium does prove defective then you may return the same to PIXEL for replacement, free of charge. Except for the limited warranty provided for a replacement medium, there are no warranties, conditions or representations, either expressed or implied by common law or otherwise and all such warranties and representations are expressly disclaimed. Your statutory rights are not affected. LIMITATION OF LIABILITY: PIXEL does not warrant that the software program will work in every hardware/software environment. The software may not work in combination with modified versions of the operating system, with certain print spooling or file facility programs, or with certain asynchronous or network port interface devices supplied by independent manufacturers. Although PIXEL has tested the software and reviewed the documentation, we do not make any warranty or representation, either express or implied, with respect to this software or documentation, including their quality, performance, merchantability, or fitness for a particular purpose. As a result, this software and documentation are licensed "as is", and you, the licensee, are assuming the entire risk as to their quality and performance. In no event will PIXEL be liable for direct, indirect, incidental or consequential damages arising out of the use or inability to use the software or documentation, even if advised of the possibility of such damages. In particular PIXEL are not responsible for any costs including but not limited to those occurring as a result of lost profits or revenues, loss of use of computer program, loss of data, the cost of substitute programs, claims by third parties or for other similar costs. You agree that regardless of the form of any claim you may have, PIXEL's (or any other party involved in the creation, production or delivery of this software) liability for any damages shall not exceed that value of the software. The value of the software is deemed to be the purchase price paid. PIXEL will not be responsible for any direct, incidental or consequential damages, such as but not limited to, loss of data or profits resulting from use of the software or arising out of any breach of warranty, even if PIXEL has been advised of the possibility of such damage. SUPPORT AND UPDATE POLICY: By completing and returning the registration card you will become a registered licensed user of the software. You can then be informed of any modifications or upgrades that may become available. By returning the card PIXEL's customer support services will then be able to assist you with technical support and help. If this registration card has not been received by PIXEL, PIXEL is under no obligation to give you any technical support or upgrade information. GOVERNING LAW: This agreement is governed by the laws of England and Wales.
